Description:

Tribal Treaty Law and Off-Reservation Resources is a two-day course addressing Tribal Treaties and Tribal involvement and tools for the protection of natural resources off Indian Reservations.

After an introduction of the historical underpinnings of Federal Indian law, and a basic overview of treaty law, the course will focus on tribal rights for fishing, hunting and water especially as applied off-reservation. Next the discussion will shift to the protection of air and water quality, waste management, and the environmental review process, including as tools to protect off-reservation resources.

The course will examine the growing tribal engagement in off-reservation environmental and resource management conflicts including infrastructure projects such as pipelines.

Finally, we will explore climate change adaptation and mitigation especially with regard to the potential role of tribes. This last topic, in particular, will involve class discussion of options and approaches of interest of the participants.

  • Tribal members and environmental staff to improve their understanding of Treaty rights and tools for protection of resources.
  • State, local and federal officials to better understand how to work with Tribes.
  • Attorneys with interest, but not a great deal of experience in Indian law.
  • Environmental group staff to better understand Tribal rights, powers and options for protecting natural resources.
  • Others who wish to better understand how to work with Tribes and in Indian Country.
